1. Acceptance of Terms

By accessing and using BimSpeed software and services ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

BimSpeed provides software plugins and tools for Autodesk Revit that automate BIM workflows, including but not limited to:

• 3D rebar modeling and placement
• Automated drawing generation
• Structural analysis tools
• Quantity takeoff features
• Team collaboration tools

3. User Accounts

To access certain features of the Service, you may be required to create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Providing accurate and complete registration information

4. License and Usage

Subject to your compliance with these Terms, BimSpeed grants you a limited, non-exclusive, non-transferable license to use the Service. You agree not to:

• Reverse engineer, decompile, or disassemble the software
• Share your license with unauthorized users
• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to any portion of the Service
• Remove or modify any proprietary notices or labels

5. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to:

• Pay all fees associated with your chosen subscription plan
• Automatic renewal of your subscription unless canceled
• Our right to change pricing with 30 days notice
• All payments are processed securely through Paddle

6. Intellectual Property

All content, features, and functionality of the Service are owned by BimSpeed and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7. User Content

You retain all rights to any content you create using the Service. However, you grant BimSpeed a license to use, store, and process your data solely for the purpose of providing the Service to you.

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIMSPEED DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

BimSpeed shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.

9. Indemnification

You agree to indemnify and hold harmless BimSpeed from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease.

11. Modifications to Terms

BimSpeed reserves the right to modify these Terms at any time. We will notify users of any material changes via email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Vietnam, without regard to its conflict of law provisions.
